Regulations Governing the Provision of Services by Electronic Means on the Website https://komentarzrodo.pl

1. Preliminary provisions

  1. This document defines the terms and conditions of use of the website available at https://komentarzrodo.pl, which is operated by WiW Services sp. z o.o. with its registered office in Warsaw, postal code 00-478, Al. Ujazdowskie 10.
  2. This document contains the rules for the provision of services by electronic means pursuant to Article 8(1)(1) of the Act of 18 July 2002 on the Provision of Services by Electronic Means.

 

2. Definitions

  1. Capitalised terms used in this document have the following meanings:
    1. Service – an Internet based service available at https://komentarzrodo.pl.
    2. WIW or Service Provider – WiW Services sp. z o.o. with its registered office in Warsaw at Al. Ujazdowskie 10, postal code 00-478.
    3. Regulations – these Regulations for the provision of services by electronic means available at https://komentarzrodo.pl/nota-prawna.
    4. User – any (natural or legal) person or other entity using the Service, including visitors to https://komentarzrodo.pl.


3. Important disclaimers regarding the nature of the Service and responsibility for its content

  1. All material provided as part of the Service is for information purposes only and cannot be treated as legal advice on any specific matter. Neither the Service Provider nor the authors of the content of the Service, nor the Law Firm Wardyński i Wspólnicy sp.k. shall be held liable for any statements made within the framework of the Service. Neither the visitors of https://komentarzrodo.pl nor any other person accessing or using the Service should rely on the content of the Service in making decisions concerning their rights or obligations, business activities, issues, disputes, claims, proceedings, etc., and should always seek individual legal advice on all matters, particularly those relating to their rights and obligations.
  2. Whilst WIW endeavours to ensure that the Service contains only up-to-date and useful material, WIW cannot guarantee the accuracy, efficacy, correctness, reliability or usefulness of any information, including legal information, displayed as part of the Service and accepts no responsibility for the accuracy, efficacy, correctness, reliability or usefulness of any legal information provided as part of the Service.

5. Nature and scope of services provided by electronic means

  1. Services provided electronically by the Service Provider on the basis of these Regulations enable Users to access the Service via the Internet for the purposes and in the manner provided for in these Regulations.
  2. Content available as part of the Service is protected under the provisions of the Act on Copyright and Related Rights of 4 February 1994, the Act on the Protection of Databases of 27 July 2001, the Act on Combating Unfair Competition of 16 April 1993 and other mandatory legal provisions protecting the Service Provider.
  3. The Service is intended for persons aged 16 or over.

 

6. Conditions for the provision of services by electronic means

  1. The Service is provided via the Internet. The Service Provider is the sole owner and operator of the Service and the website on which the Service is located.
  2. Use of the Service implies acceptance by the User of these Regulations.
  3. The User is obliged to comply with the provisions of these Regulations.
  4. The Service Provider does not charge for the use of the Service.
  5. The use of the Service is subject to the following minimum technical requirements: connection to the Internet, a device with Internet access that allows the use of Internet resources and a web browser that is properly configured, in an up-to-date version that allows hypertext documents linked to the Internet via a web-based service to be displayed on the screen of the device, and that supports the JavaScript programming language.
  6. Users are is prohibited from providing illegal content to or through the Service.
  7. Users may not use any viruses, bots, worms or other computer codes, files or programmes (including, without limitation, automated scripts and applications or other codes, files or tools) that enable the Service to be used in a manner contrary to its purpose, these Regulations or the law.
  8. Users shall use the Service: (i) in accordance with its purpose as a service that presents only content of an informative and popularising nature, (ii) in accordance with the law, and (iii) in a manner that is compatible and consistent with the nature of the Service, subject in particular to the provisions of clause 3 above.

 

7. Conditions for the conclusion and termination of the contract for the provision of services by electronic means

  1. A contract with WIW for the use of the Service is concluded each time the User accesses the Service via a web browser (i.e. when the content of the Service is displayed by the User's web browser), and a contract for the use of the Service is terminated with immediate effect each time the User stops using the Service.
  2. Pursuant to the contract referred to in clause 7.1 above, the Service Provider grants the User access to the Service, enables the User to use its functions and undertakes to apply its best efforts to ensure that the Service operates continuously and without interruption.
  3. Due to the nature of the services available through the Service, the User does not have the right to withdraw from a contract for the provision of services by electronic means once it has been concluded. However, the User may terminate the contract at any time with immediate effect by stopping using the Service.

 

8. Responsibility for the operation of the Service

  1. The Service Provider undertakes, as far as possible, to give prior notice of interruptions to the Service, in particular in the event of maintenance and technical interruptions.
  2. The Service Provider endeavours to ensure that the Service is available continuously and without interruptions. However, the Service Provider stipulates that it is not possible to exclude failures, errors or other situations (such as updates) which may make the use of the Service impossible or difficult. To the fullest extent permitted by mandatory provisions of law, the Service Provider shall not be liable in any way for damages related to the occurrence of the events referred to in the preceding sentence.

 

9. Complaints

  1. Any User has the right to file a complaint regarding the operation of the Service.
  2. Complaints should be sent electronically to the e-mail address rodo@wardynski.com.pl or in writing to the address of the Service Provider. The complaint should, as far as possible, describe the problem with the functioning of the Service.
  3. The Service Provider shall respond to the complaint within 14 days of its receipt.
  4. The Service Provider shall send its response to the complaint to the email address indicated in the complaint. If the complaint is made in a letter, the response shall be sent to the e-mail address provided in the letter. If no e-mail address is provided, the response will be sent to the postal address from which the complaint was sent.

 

10. Disputes

  1. Any disputes relating to the provision of services by electronic means to which these Regulations apply shall be settled by the competent ordinary courts.
  2. Consumers using the Service have access to the EU online platform for the out-of-court settlement of consumer disputes, available at: ec.europa.eu/consumers/odr.

 

11. Changes to the Regulations

  1. The Service Provider reserves the right to change the content of these Regulations from time to time. After making any such change, the Service Provider shall post a notice of the change 14 days before it comes into effect.

12. Final provisions

  1. The use of the Service involves the processing of the User’s personal data – for more information on the processing of personal data, please refer to the Service’s Privacy Policy, available at: https://komentarzrodo.pl/en/privacy-policy.
  2. These Regulations and contracts for the provision of services by electronic means controlled by these Regulations shall be governed by Polish law.
  3. These Regulations are made available free of charge on the Internet at the address specified in clause 11.2 above in such a way that their contents can be obtained, reproduced and recorded by means of a computer and similar devices.
  4. In the event of a conflict between the provisions of these Regulations and the mandatory provisions of Polish law, the mandatory provisions of Polish law shall prevail.
